Electronic Complaint Book

On the 11st of March 2020, entered into force Decree-Law no. 9/2020, 10th March, which amended Decree-Law no. 156/2005, 15th September – which establishes the obligation for suppliers and providers to have a complaint book in paper and electronic format –, settling measures intended to the compliance of the obligation to have an electronic complaint book.

In order to facilitate compliance with said obligation, it was created a new mechanism of notice to the offender, previously to the start of any administrative offense procedure for breaching duties arising from the obligation to have an electronic complaint book, allowing the offender to implement, within 90 days, any relevant measures in order to comply with the applicable obligations.

This measure allows the technological transaction that challenges some of the economic operators. It also establishes a transitional provision, applicable to ongoing procedures.
