New Remote Working Regime and Other Changes Introduced in the Labour Code

16 December, 2021Law no. 83/2021 of 06/12 was published, modifying the remote working regime, amending the Labor Code and the regime that regulates the compensation system for accidents at work and occupational diseases.
The new law establishes the duty to abstain from contact, which consists of a concrete duty of the employer not to contact the employee during the rest period, except in situations of force majeure.
The regime now also provides the conditions of the remote working agreement, the terms of the duration of the agreement and its termination and the situations in which the right to remote working applies.
Finally, the new law establishes the employer’s obligation to provide the worker with the equipment and systems necessary for the performance of the work and the interaction worker-employer, conditions of equal rights and duties between employees of the company in a remote working regime and outside of it, with the same category or identical function, conditions of the worker’s privacy, working hours and rest and rest time for him/her and his/her family, organization, direction and control of work and the specific duties imposed on the employer in the context of teleworking, namely duties relating to safety and health at work.
