Decree-Law no. 87/2024 of 07.11, regulating the citation and notification of individuals and companies in court proceedings by electronic means, was published amending several rules and legislation, and implementing a project provided in the Recovery and Resilience Plan (RRP).

Decree-Law no. 87/2024 of 07.11 establishes that it is now the rule for legal persons to be served through a digital reserved area with free access, although personal service by post is still possible. For that purpose, the entities must register in the digital reserved area, which will be ruled through a different regulation which shall be published within 90 days counting from the date in which Decree-Law 87/2024 of 07.11. shall enter into force. In case of legal persons who do not register in the reserved area, they will be served by post mail. However, they will have to pay a fee that will be set in the Procedural Costs Regulation.

Natural persons will now be able to choose to receive electronic communications in the context of Court proceedings, and to do so they must register their e-mail address in the digital reserved area that will be created and ruled in a separate regulation.

Finally, this decree-law eliminates the use of faxes and telegrams as a way of communication in court proceedings.

Decree-Law 87/2024 of 07.11 comes into force on November 10th. However, there will be a transitional period of six months, during which the legislation regulating the digital reserved area for legal entities and natural persons will also be published.
